DECISION & ORDER Appeals by the People (1) as limited by their brief, from so much of an order of the County Court, Orange
County (Berry, J.), dated July 28, 1992, as granted that branch of the defendant's omnibus motion which was to dismiss the
first two counts of the indictment, and (2) from so much of an order of the same court, dated September 14, 1992, as, upon
reargument, adhered to the original determination. Ordered that the appeal from the order dated July 28, 1992, is dismissed, as that order was superseded by the order dated
September 14, 1992, made upon reargument; it is further, Ordered that the order dated September 14, 1992, is reversed insofar
as appealed from, so much of the order dated July 28, 1992, as granted that branch of the defendant's omnibus motion which
was to dismiss the first two counts of the indictment is vacated, that branch of the defendant's omnibus motion is denied,
those counts of the indictment are reinstated, and the matter is remitted to the County Court, Orange County, for further
proceedings consistent herewith.
